You are prohibited from misusing our Services, including but not limited to disrupting our services or attempting to access the Indonesian Migrant Worker Placement System through means other than the interface and instructions we provide. You may only use our Services as permitted by law, including but not limited to applicable export and re-export control regulations. We may suspend or terminate the provision of Services to you if you fail to comply with our terms and conditions or policies, or if we are investigating suspected violations.

Using our Services does not grant you ownership rights over any intellectual property within the Services or the content you access. You may not use content from our Services unless you have obtained permission from its owner or as otherwise permitted by law. These terms do not grant you the right to use any trademarks or logos used within our Services. You are also prohibited from removing, obscuring, or altering any legal notices displayed within or alongside our Services.

Our Services may display certain content that does not belong to the Indonesian Migrant Worker Placement System. Such content is the sole responsibility of the party that provides it. We may review such content to determine whether it violates the law or our policies, and we may remove or refuse to display content that we reasonably believe violates applicable laws or policies.

In connection with your use of the Services, we may send you service announcements, administrative messages, and other relevant information.

As a condition of use, you hereby agree not to use the Services for any purpose prohibited by these Terms and Conditions of Service. You are responsible for all activities conducted in connection with your use of the Services.

You are not permitted, nor may you allow any third party, to engage in the following actions:

(i) Engaging in any act or uploading, downloading, posting, transmitting, or distributing any content on or through the Services, including but not limited to user content, that:

• Infringes on patents, trademarks, trade secrets, copyrights, rights of publicity, or any other rights of any person or entity, or violates any laws or contractual obligations;
• You know to be false, misleading, or inaccurate;
• Violates any laws, threatens, harasses, defames, deceives, misleads, invades another person’s privacy, is obscene, indecent, pornographic, offensive, contains or displays nudity, contains or depicts sexual activity, or is otherwise deemed inappropriate at our sole discretion;
• Constitutes unauthorized or unsolicited advertising, junk mail, or mass email (spamming);
• Contains software viruses or any other code, files, or programs designed to interrupt, damage, limit, or interfere with the functionality of any software, hardware, or telecommunications equipment, or to damage or gain unauthorized access to our systems, data, passwords, or other information belonging to us or any third party;
• Impersonates any person or entity, including our employees or representatives; or
• Includes any person’s identification documents or sensitive financial information.

Additionally, you are prohibited from:

(ii) Taking any action that imposes, or may impose (at our sole discretion), an unreasonable or disproportionately large load on our infrastructure (or that of our third-party providers);
(iii) Disrupting or attempting to disrupt the proper functioning of the Services or any activities conducted therein;
(iv) Bypassing, circumventing, or attempting to bypass or circumvent any measures we use to prevent or restrict access to the Services (including access to other accounts, computer systems, or networks connected to the Services);
(v) Initiating any form of automated response or spam within the Services;
(vi) Using any software, device, or manual or automated process to "crawl" or "scrape" any page of the Site;
(vii) Collecting or harvesting any content from the Services; or
(viii) Engaging in any other actions that violate our guidelines and policies.
(ix) Other Prohibited Activities

You are not permitted, either directly or indirectly, to:

(x) Disassemble, decompile, dismantle, reverse engineer, or attempt to derive the source code, underlying ideas, or algorithms of any part of the Services (including, but not limited to, applications), except to the extent that applicable law expressly permits such restrictions;
(xi) Modify, translate, or create derivative works of any part of the Services; or
(xii) Copy, rent, lease, distribute, or transfer any rights granted to you under these Terms. You must comply with all applicable local, state, national, and international laws and regulations.

We also reserve the right to access, review, store, and disclose any information we deem necessary to:

(xiii) Comply with applicable laws, regulations, or legal processes;
(xiv) Enforce these Terms and Conditions of Service, including investigating potential violations;
(xv) Detect, prevent, or address fraud, security issues, or technical concerns;
(xvi) Respond to user support requests; or
(xvii) Protect our rights, property, or safety, as well as those of our users and the public.

You must have a PMI Placement System Account to use our Services. You are required to provide accurate and complete information and to keep your account information up to date. You are not allowed to:

(i) Select or use a username that is the name of another person with the intent to impersonate that person;
(ii) Use a username that is owned by another party without proper authorization; or
(iii) Use a username that is offensive, vulgar, or inappropriate.

You are fully responsible for all activities that occur under your account and for maintaining the security of your account password. You must not use another user’s account or registration information without authorization. You must immediately notify us of any changes affecting your eligibility to use the Services (including changes or revocation of licenses by local authorities), any security breaches, or unauthorized use of your account. You are also prohibited from publishing, distributing, or sharing your login credentials.

You may delete your account either directly or by requesting deletion through one of our employees or affiliates.

To protect your PMI Placement System Account, keep your password confidential. You are responsible for all activities that occur within your account.

By using the Services, you represent and warrant that you are at least 18 years old. If you are under 18, you are strictly prohibited from using the Services under any circumstances or for any reason. We reserve the right, at our sole discretion, to refuse service to anyone and to modify eligibility criteria at any time.

You are fully responsible for ensuring that these Terms and Conditions of Service comply with all applicable laws, regulations, and policies relevant to you. Your access to the Services may be revoked if your use of the Services is prohibited or in violation of any applicable laws, regulations, or policies. Additionally, the Services are offered solely for your personal use and not for the benefit of any third party.

The PMI Placement System may require you to upload certain documents to verify your eligibility as a user of the system. You are responsible for ensuring that the uploaded documents contain accurate information. By using the Services, you grant permission to the PMI Placement System to share your information with relevant authorities if necessary.

The PMI Placement System acts as a payment intermediary between Recruitment Agencies in Destination Countries and Indonesian Placement Agency (P3MI) to ensure that both parties fulfill their obligations before funds are disbursed. The PMI Placement System does not determine the payment amounts or terms. Any pending payments in your account depend on the work order and payment terms set by P3MI.

Once a Recruitment Agency in the Destination Country creates a work order, P3MI will generate an invoice based on the agreed-upon pricing. The staggered payment structure may vary depending on P3MI’s policies.

After the order is completed, P3MI will immediately issue an invoice and send an irrevocable payment obligation to the Recruitment Agency in the Destination Country. Upon receiving this invoice, the Recruitment Agency must proceed with the payment according to the terms set by P3MI.

Once your request is approved, you will be notified via the PMI Placement System regarding:

(i) The total amount of your request;
(ii) The payment schedule, including the amount and due date for each installment; and
(iii) The payment method you selected.

You must confirm that you have reviewed and agreed to this information. These details will also be available in your PMI Placement System account.

All transactions conducted through the PMI Placement System can only be made via bank transfer or credit/debit card. Ensure that you do not make any payments without verifying that the amount matches the agreed-upon terms.

You agree that once a request is confirmed and payment has been made, you cannot cancel the request, except in the following cases:

(i) The request was made under the wrong category;
(ii) No payments of any kind have been made to a third party; or
(iii) Cancelling the request does not affect any parties involved

Links originating from or directing to external websites outside of the PMI Placement System are provided for convenience only. These linked websites are owned and operated by third parties and are therefore beyond the control of the PMI Placement System.

The PMI Placement System is not responsible for and does not guarantee the content of such websites, the third parties mentioned therein, or their products and services.

Any links provided on this site should not be considered as endorsements, verifications, or approvals of the linked websites or their content. Accessing external websites via these links is entirely at your own risk, and the PMI Placement System is not liable for any losses resulting from such links.

(ii) Closure/cancellation of programs by third parties/relevant authorities.;

You agree to indemnify and hold harmless the PMI Placement System from all liabilities, claims, losses, and costs, including any legal fees, that may arise due to:

(i) Your use or misuse of the PMI Placement System and its services.;

(iii) Third-party claims of intellectual property rights infringement related to your use of the PMI Placement System

Where permitted by law, the PMI Placement System and its service providers are not responsible for Loss of profits, revenue, or data; Financial losses or indirect, special, consequential, exemplary, or punitive damages;

To the extent permitted by law, the total liability of the PMI Placement System and its service providers for claims under these terms, including for implied warranties, is limited to the amount you paid to use the Service (or, at our discretion, the re-provision of the Service to you).;

In all cases, the PMI Placement System and its service providers are not responsible for any losses or damages beyond the services provided.

We continuously improve and enhance our Services. We may add or remove functions or features and may also suspend or terminate the Services entirely, with or without prior notice to users.

You may stop using our Services at any time. The PMI Placement System may terminate service provision to you, or introduce new limitations on our Services at any time.

These Terms of Service are governed by and interpreted in accordance with the laws of the Republic of Indonesia. By accessing the PMI Placement System and/or using the services provided therein, you hereby agree to the exclusive jurisdiction of the courts of the Republic of Indonesia for any disputes arising from or related to the use of the PMI Placement System.
